Terms of Service

These Terms of Service ("Terms") govern your access to and use of FlowCheck's website and monitoring service (the "Service"). By using the Service, you agree to these Terms. If you are agreeing on behalf of a company, you confirm you have the authority to bind that company.

1. The service

FlowCheck runs synthetic browser checks against the user journeys you ask us to monitor, on a recurring schedule, and notifies you when a check fails. The exact scope, frequency and run regions are agreed with you as part of your plan.

2. Your responsibilities

  • You must own, or have permission to monitor, the websites and flows you ask us to check.
  • You are responsible for the accuracy of the configuration and any test credentials you provide.
  • You agree not to use the Service to test systems you are not authorised to access, or in any way that breaks the law.
  • You will keep your account credentials secure and notify us of any unauthorised use.

3. Acceptable use

You may not use the Service to launch denial-of-service attacks, to probe third-party systems without authorisation, or to place an unreasonable load on any infrastructure. We may suspend checks that we reasonably believe are harmful or abusive.

4. Fees and billing

Paid plans are billed in advance on the cycle agreed at sign-up. Unless stated otherwise, fees are non-refundable. We will give you reasonable notice of any change to pricing. Free audits are provided at no cost and carry no obligation.

5. Availability

We work hard to keep the Service reliable, but it is provided on a best-effort basis. Monitoring depends on third-party infrastructure and on your own site being reachable. The Service is a safety net and does not replace your own testing, QA and incident response.

6. Intellectual property

FlowCheck and its software, branding and content remain our property. The monitoring scripts and artefacts created specifically for your flows are made available to you for use with the Service. You retain all rights to your own websites and data.

7. Confidentiality

Each party agrees to protect the other's confidential information and to use it only to deliver or use the Service. This includes any credentials, screenshots and traces generated during monitoring.

8. Limitation of liability

To the maximum extent permitted by law, FlowCheck is not liable for indirect, incidental or consequential damages, or for lost revenue or profits, arising from your use of or inability to use the Service. Our total liability in any twelve-month period is limited to the fees you paid us during that period.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms. On termination, we will stop running your checks and delete your monitoring data in line with our Privacy Policy.

10. Governing law

These Terms are governed by Belgian law, and any disputes will be subject to the exclusive jurisdiction of the courts of Belgium, unless mandatory consumer law provides otherwise.
